ACE-Scanner — Terms & Conditions

Last updated: October 2026. Please read carefully before using the scanner.

By ticking the acceptance box, installing the ACE-Scanner bookmark or using the service, you confirm that you have read, understood and agreed to be bound by these terms.

1. Use at Your Own Risk

You use ACE-Scanner entirely at your own risk. The developers, providers and their affiliates are not responsible for any outcome of that use, including service interruptions, restrictions placed by a third-party platform, or financial loss. Everything the scanner does in your session, including its automated actions and data requests, is your responsibility.

2. Independent Tool and Third-Party Platform Rules

ACE-Scanner works by automating actions inside your own signed-in browser session on third-party websites and marketplaces. It is an independent product. It is not affiliated with, sponsored, approved or endorsed by any marketplace, portal or platform. You must follow the terms of use, rate limits and security rules of every platform you use it on. We do not promise that the scanner complies with those rules, and we are not responsible for account bans, suspensions, throttling or other restrictions imposed on you.

3. Suspension and No Refunds

We may suspend or end your account and licence at any time, with or without notice, if we find a breach of these terms, misuse of the service, unauthorised sharing of access, or signs of reverse engineering. All fees and licence payments are non-refundable in every case.

4. Data We Keep

We keep only what is needed to run the service and show your usage. This includes lead details such as the title or product, matched keyword, country and reference number, and counts of leads taken. If your organisation turns on lead saving for an employee, the lead record the scanner reports, which can include buyer contact details, is stored on our servers and shown to your organisation in its dashboard. We do not sell your data.

5. Security

We do not sell, rent or share your information with outsiders, and we take reasonable steps to protect it. Your sign-in token and settings are kept in your browser on your device. You are responsible for keeping your device and browser secure.

6. Provided at Your Request

ACE-Scanner is provided to you because you or your organisation asked for it, purchased a licence and authorised its use for personal or internal business automation.

7. Your Credentials

The login details you enter, such as phone number, email and password, are supplied by you voluntarily so the scanner can work. You are solely responsible for keeping them confidential and secure.

8. No Warranty; Changes to Third-Party Sites

The scanner is supplied “as is” and “as available”. We do not promise it will run without interruption, errors or security issues. Third-party websites change their structure and interfaces often, and such changes can stop the scanner from working. We aim to release fixes but cannot guarantee that it will stay compatible.

9. Intellectual Property and Restrictions

The source code, scripts, logic, matching methods, layout, branding and other assets of ACE-Scanner belong only to the providers and are protected under the Copyright Act, 1957 and the Information Technology Act, 2000. You agree not to, directly or indirectly: (a) copy, change, distribute, reverse engineer, decompile, unpack, de-obfuscate, intercept the service’s network calls, or extract its code or logic; (b) licence, sub-licence, resell or pass the software or your access to anyone else; or (c) use the software, its methods or its workflows to build, train, test, support or market any competing automation tool, browser extension or lead management product.

10. Agreed Damages for Code Theft (₹15,00,000)

You accept that the code, methods and workflows of ACE-Scanner are valuable trade secrets built with significant effort, and that copying, extracting or cloning them causes serious harm that cannot be measured exactly when it occurs. If you breach the intellectual property or restriction terms above, you agree to pay the providers ₹15,00,000 (Rupees Fifteen Lakhs Only) for each occurrence, as a genuine advance estimate of loss and not as a penalty, under Section 74 of the Indian Contract Act, 1872. This does not limit the providers’ right to seek urgent interim and permanent injunctions (Order 39 Rules 1 and 2 CPC; Specific Relief Act, 1963), to claim further actual damages or an account of profits above this sum, or to start criminal proceedings under Sections 43, 66 and 66B of the Information Technology Act, 2000 and Sections 63 and 64 of the Copyright Act, 1957.

11. One Licence, One User, One Device

Each login is personal to one user, is not transferable, and may be used on one authorised browser and device at a time. You must not share your login, run several sessions at once from different devices or networks, use headless browsers, or route our service through a proxy. If we detect parallel logins or switching between devices, we may block or cancel access automatically and without a refund.

12. Monitoring and Electronic Records

You agree that the scanner may send us diagnostic data, activity pings, version checks and tamper alerts. You also agree that our server logs, ping times, IP records and security alerts, kept and verified with cryptographic hashing such as SHA-256, are valid and conclusive electronic evidence in any proceeding, including under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 (and Section 65B of the Indian Evidence Act, 1872).

13. Limit of Liability and Indemnity

To the fullest extent the law allows, our total liability connected with the software is capped at the lower of (i) the fees you paid in the three months before the event, or (ii) ₹5,000 (Rupees Five Thousand Only). We are not liable for indirect, incidental, consequential, special or punitive loss. You agree to defend and indemnify the developers and providers against third-party claims, marketplace penalties or losses arising from your automated use or your breach of these terms. This cap does not apply to your breach of the intellectual property or restriction terms, or to the agreed damages above.

14. Governing Law and Arbitration

These terms are governed by the laws of India. Any dispute arising from them will be settled finally by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator chosen jointly by the parties (or appointed under Section 11). The seat and venue is New Delhi, and the language is English. Subject to arbitration, the Commercial Courts at New Delhi have exclusive jurisdiction under the Commercial Courts Act, 2015. The providers may still approach any competent court for urgent interim relief under Section 9 of the Arbitration Act or Order 39 of the Code of Civil Procedure, 1908.

15. Severability and Survival

If any part of these terms is found invalid or unenforceable, the rest stays in force. The sections on intellectual property, agreed damages, indemnity, electronic records and dispute resolution continue to apply after this agreement is cancelled, suspended or ends.

If you do not agree, stop using the scanner and remove its bookmark. This agreement becomes legally binding when you activate the scanner.
